Guidance Material — Regulation (EU) No 376/2014 and its implementing rules · Regulation (EU) No 376/2014 · EAR revision 27 Sep 2023

## 2.6If I report an accident or serious incident under Regulation 376/2014, am I also required to report it to the State of Occurrence?

2.6 If I report an [accident](https://avioverse.aero/glossary/easa/accident) or [serious incident](https://avioverse.aero/glossary/easa/serious-incident) under Regulation 376/2014, am I also required to report it to the State of [Occurrence](https://avioverse.aero/glossary/easa/occurrence)?

Accidents and serious incidents, as defined within Regulation (EU) No 996/2010, are also subject to Regulation 376/2014 (Article 2(7)).

This should not interfere with the implementation of Regulation (EU) No 996/2010 and in particular, the notification of occurrences to the [safety investigation authority](https://avioverse.aero/glossary/easa/safety-investigation-authority) (SIA) of the State of Occurrence in the context of Article 9 of that Regulation (Recital 3).

It means double reporting could be required in a situation where a person subject to mandatory reporting obligations in accordance with Article 4(6) has to report an accident or a serious incident listed in Regulation 2015/1018.

In such cases, this person shall report the accident or serious incident in accordance with Article 4(6) of Regulation 376/2014 and shall also ‘‘notify without delay the competent safety investigation authority of the State of Occurrence thereof’’ in accordance with Article 9 of Regulation (EU) No 996/2010.

| Example: A pilot in command being aware of an accident or a serious incident listed in Annex I of Regulation 2015/1018 and which occurred in the United Kingdom is required to report it to his/her [organisation](https://avioverse.aero/glossary/easa/organisation) as well as to the UK SIA (the UK Air Accidents Investigation Branch). |
